Planports Terms of Service
1. Parties to the Agreement
1.1. This Membership Agreement (hereinafter referred to as the "Agreement") is concluded between Tekvita Software Computer Consultancy Advertising Organization Tourism Industry and Trade Ltd. Co. (hereinafter referred to as "Planports") and the "User" who registers on the website at www.planports.com and uses the services offered. The Agreement shall come into effect upon its electronic acceptance by the User and shall remain in force as long as it is not terminated in accordance with the procedures specified herein.
2. Subject and Scope of the Agreement
2.1. This Agreement covers the use of the cloud-based Pre-Accounting and CRM Platform ("Platform") accessed through Planports by the User, the privacy and security of data uploaded to the Platform by the User ("Data"), the terms and conditions regarding the content, and the determination of the rights and obligations of the parties.
2.2. If the Platform is used on behalf of a company account, the user who opens the account is considered the "System Administrator" and is deemed to have accepted this Agreement on behalf of the company and declared that they have the authority to do so.
3. User Rights and Responsibilities
3.1. The User must be at least 18 years of age to register on the Platform. By registering on the Platform, the User accepts and declares that they are at least 18 years of age and have the legal capacity required to enter into the agreement.
3.2. The User declares and accepts the accuracy of the User and company information used when registering on the Platform. The User is responsible for the accuracy and currency of the name, surname, email, company name, company billing information and other subscription information used when registering on the Platform.
3.3. If the User uses the Platform on behalf of a company, they have the authority to define as many users as allowed in the account plan. In this case, the accuracy of the data belonging to these individuals is the responsibility of the User.
3.4. Access to the Platform by the User is provided using the email address and the password set by the User. The confidentiality and security of this password is the responsibility of the User, and any activity carried out through the Platform using the relevant email address is deemed to have been performed by the User.
3.5. The User accepts and declares that the email address will be used for all issues and communication, and that it is the User's responsibility to regularly check the email address to be informed by the Site.
3.6. The username and password can only be used by the relevant User. Sharing the username and password with other persons is prohibited. If the User detects unauthorized use of their password by other persons or a breach of security in any other way, they must immediately notify Planports and change their password through a secure browser.
3.7. The User is responsible for the compliance of the Data stored on the Platform and their activities with the tax laws, commercial laws and other applicable legislation of the country where the company operates, as well as with international legal rules. The use of the Platform for illegal purposes is prohibited.
3.8. The User is responsible for ensuring that the files uploaded to the Platform do not contain malicious software such as viruses, bugs, trojans, etc.
3.9. The User is responsible for backing up the Data uploaded to the Platform.
3.10. The User is obligated not to use the Platform for illegal purposes, not to neglect security measures, not to upload data to the system through intermediary software not permitted by Planports, not to use the Platform for unauthorized transmissions, and not to host illegal content.
3.11. The User may not transfer their user account and the rights and responsibilities arising from this Agreement and their use of the Platform to any third party in any manner.
4. Planports' Rights and Responsibilities
4.1. While Planports complies with all necessary protocols and procedures and takes measures to prevent the loss of Data on the Platform, it cannot guarantee that Data loss will not occur. Planports is not responsible for any Data lost on the Platform regardless of how it occurs.
4.2. Planports is obligated not to access, view or share the User's Data entered on the Platform without the User's permission. However, if the User's information and data on the Platform is requested by authorized authorities through a court order, Planports is obligated to share this information and data with the authorized authorities.
4.3. Planports may revise this Agreement without any prior notification. Following the publication of the revision, the User shall be deemed to have accepted the revised agreement upon their first access to the Platform.
4.4. In the event that the User acts contrary to the other conditions and terms within this Agreement and the Site, and the declarations and commitments within this scope, the Company shall have the right to suspend the User's membership or terminate the Agreement and thus end the user status.
4.5. Planports aims to ensure that the use of the Platform is accessible and usable 24/7, but does not guarantee that it will be uninterrupted and error-free. The User accepts that access to the Platform may be blocked or interrupted when necessary.
4.6. Planports has the right to store content in its databases as long as the agreement is in effect.
5. Payment, Refund, Changes and Account Suspension
5.1. A valid credit card is required for a paid Planports subscription. Payment for each service period is collected before the service begins and is non-refundable. When you switch to a paid Planports subscription, your free usage automatically ends and your paid subscription begins.
5.2. Planports provides Users with the Platform free of charge for 14 days. After 14 days, if the User does not upgrade to a paid membership, the User's account will be suspended. Planports reserves the right to change the free membership period at its discretion.
5.3. When your account is suspended, your information is retained for 6 (six) months from the date of suspension. If you decide to reuse your account within this period, you can access your information after making your subscription payment. If you do not reuse your account within this period, all your information will be permanently deleted at the end of this period.
5.4. If Planports believes it has encountered usage that would put the security of the software at risk, malicious usage, or usage that would put Planports in a difficult position, it may close your company's account or block your access to all or part of the account, with or without prior notice.
5.5. Planports may make changes to the services it offers or may discontinue all or any portion of its services, temporarily or permanently, with or without notice. Planports cannot be held responsible for such changes or interruptions.
5.6. Following Planports' announcement of changes to price schedules and payment conditions on the www.planports.com website and in the Account section within the Platform, Users who wish to renew their subscription will be charged at the new price schedule.
5.7. The User agrees in advance that Planports has the right not to accept membership even if they meet the conditions, and may delete membership when necessary.
6. Duration of the Agreement
6.1. The Agreement shall come into effect upon its electronic acceptance by the User and shall remain in force during the User's membership period unless terminated by the parties in accordance with the procedures specified in the Agreement.
6.2. The invalidity, illegality and unenforceability of any provision or expression of the Agreement shall not affect the validity and enforceability of the remaining provisions of the Agreement.
6.3. Termination of the Agreement shall not eliminate the rights and obligations of the parties that have arisen up to the date of termination.
7. Copyrights
7.1. The Platform is the property of Planports. The right and authority granted to the User to use the Application does not in any way constitute a transfer of ownership of the Platform to the User.
7.2. It is strictly prohibited for the User to attempt to access the source code of the Platform, modify, corrupt, or copy the code.
7.3. The User may not use the name, trade name and logo of Planports without the permission of Planports.
7.4. Planports may not use the User's name as a Reference on its website unless the "System Administrator" gives permission.
8. Limitation of Liability
8.1. The User accepts and declares that links may be provided through the Site to other internet sites and/or portals, files or content that are not under the control of the Company, and that such links do not serve as a means of endorsing the internet site or its operator, and the Company bears no responsibility for the portals, internet sites, files and content, services or products accessed through such links or their content.
8.2. The User accepts that the quality of the Application and access to Applications offered through the Site is largely based on the quality of the service obtained from the relevant Internet Service Provider, and the Company bears no responsibility for issues arising from such service quality.
9. Privacy Policy
This article defines the data privacy principles regarding the access, use and updating of data provided by the user.
9.1. When you become a member of Planports, access protocols are configured so that only you and persons authorized by you can access your information, with privacy and security measures applied without error.
9.2. Our use of data provided by users is limited to providing the service and maintaining technical support. This information may be used to improve service quality and to develop and enhance Planports.
9.3. Planports only stores the user's email address, name, title, phone number and company information provided during user registration. Credit card information is not stored without the user's permission during payment.
9.4. The User may provide information such as name, surname, and email to invite different people. This information entered is used only for its intended purpose.
9.5. Planports may send informational emails to its users. The User may remove themselves from the email list. Please follow the unsubscribe links for this process.
9.6. Cookies are used to maintain user settings and perform certain analyses. If the user does not want cookies to run on their computer, they can be blocked through browser settings. In this case, the user can continue using Planports but may encounter some limitations.
9.7. Cookies may also be used to display advertisements on other sites. These cookies may be placed on the Planports website for the purpose of receiving advertising services from third-party companies.
9.8. The security of user information is important to us. When the user enters payment information, credit card details and similar data, we encrypt and transmit this information using an SSL certificate. The security measures we use aim to prevent user information from being lost, stolen, and damaged. However, by its nature, the security of information transmitted over the internet can never be 100% guaranteed. 9.9. Planports provides integration with Google Drive. Authorization information such as email passwords used for integration is not stored by Planports. It is only used by Google for authorization purposes.
10. Dispute Resolution
10.1. Antalya Courts and Enforcement Offices are authorized for disputes arising from this Agreement.
