Personal Data Protection Law (KVKK) Information Notice
As Tekvita Software Ltd. Şti. ("Tekvita"), we place great importance on the privacy and security of your personal data. We make every effort to ensure that personal data belonging to individuals associated with Tekvita are processed and protected in accordance with the Personal Data Protection Law No. 6698 ("KVK Law"). In this context, Tekvita, as the Data Controller, processes your personal data under the conditions described below and within the limits prescribed by law, in accordance with the KVK Law.
1. Collection, Processing, and Purposes of Processing Personal Data
Your personal data may vary depending on the services provided by Tekvita and Tekvita's commercial activities; it may be collected verbally, in writing, or electronically through automatic or non-automatic methods, Tekvita units, offices, websites, social media platforms, mobile applications, and similar channels. Your personal data may be processed by being created and updated as long as you benefit from Tekvita's products and services. In addition, your personal data may be processed when you use our call center or website to benefit from Tekvita's services, visit Tekvita or our website, or attend training, seminars, or organizations organized by Tekvita.
Your collected personal data may be processed by the relevant units to carry out the necessary activities to make you benefit from the products and services offered by Tekvita, to offer you products and services customized to your preferences, usage habits, and needs, to ensure the legal and commercial security of Tekvita and individuals or legal entities with whom Tekvita has a business relationship, to determine and implement Tekvita's commercial and business strategies, and to ensure the execution of Tekvita's human resources policies, within the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVK Law.
2. To Whom and For What Purposes Processed Personal Data May Be Transferred
Your personal data may be transferred to our business partners, suppliers, group companies, affiliates, companies, and institutions with which we cooperate, companies from which we receive services to fulfill our contractual or legal obligations (in matters such as security, information technologies, occupational safety, law, audit, finance, and similar subjects), authorized official institutions and organizations, limited to the purposes specified in this notice and under the conditions specified in Articles 8 and 9 of the Law.
3. Method and Legal Basis for Collecting Personal Data
Depending on the services, products, or commercial activities provided by Tekvita, your personal data may vary. In accordance with Articles 4, 5, and 6 of the KVKK, your personal data;
• In compliance with the law and the rules of honesty
• Accurately and, when necessary, updated
• For specific, explicit, and legitimate purposes
• Processed in connection with, limited to, and measured by the purposes for which they are processed
• In compliance with the rules on retention for the period specified in the relevant legislation or required for the purpose for which they are processed, may be collected verbally, in writing, or electronically through automatic or non-automatic methods by Tekvita units, offices, websites, social media platforms, mobile applications, and similar channels, and may be processed by updating them. Your personal data may be obtained for the purpose of ensuring that Tekvita can provide the products and/or services we offer within the legal framework determined, and in this context, Tekvita can fully and accurately fulfill its contractual and legal obligations. Your personal data collected for this legal reason may be processed and transferred for the purposes specified in clauses (1) and (2) of this notice within the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVK Law.
4. Rights of the Personal Data Owner Under Article 11 of the KVK Law
As personal data owners, if you submit your requests regarding your rights to Tekvita in accordance with the methods set out in this Information Notice, Tekvita will conclude your request free of charge within sixty days at the latest, depending on the nature of the request. However, if a fee is determined by the Personal Data Protection Board, Tekvita will charge the fee in the tariff determined by Tekvita. In this context, personal data owners have the right to;
• Learn whether personal data is processed or not,
• Request information if personal data has been processed,
• Learn the purpose of processing personal data and whether they are used in accordance with their purpose,
• Know the third parties to whom personal data is transferred at home or abroad,
• Request correction of personal data if it is incomplete or incorrectly processed and request that the process performed in this context be notified to third parties to whom personal data has been transferred,
• Despite being processed in accordance with the provisions of the KVK Law and other relevant laws, request the deletion or destruction of personal data if the reasons for processing no longer exist, and request that the process performed in this context be notified to third parties to whom personal data has been transferred,
• Object to a result arising against the person by analyzing the processed data exclusively through automated systems,
• Request compensation for the damage in case of damage due to the unlawful processing of personal data.
In accordance with Article 13, paragraph 1 of the KVK Law, you can submit your request to exercise your rights listed above, in writing, in person, through a notary, or by using other methods determined by the Personal Data Protection Board, to Tekvita. In the application;
a) Your name, surname, and if the application is in writing, your signature,
b) For citizens of the Republic of Turkey, your Turkish identity number, if you are a foreigner, your nationality, passport number, or if any, your identity number,
a) Your place of residence or workplace address for notification,
a) If any, your email address, telephone, and fax number for notification,
a) Your subject of request must be included. The relevant information and documents should be attached to the application.
